1) CONFIRMATION
A signed booking form is required. On receipt of the booking form a
confirmation and invoice will be forwarded to you or your travel agent
within four working days.
2) PAYMENT
A deposit of £150.00 per person is required at the time of booking.
The balance payment is payable 8 weeks before departure. If the payment
is not received on the due date we shall treat the booking as cancelled.
INDUS TOURS & TRAVEL LIMITED reserves the right to levy cancellation charges
as published. If you have booked your holiday within 8 weeks of the date of
departure, the total cost of the holiday will be payable at the time of booking.
If the booking is made through a travel agent, any monies held by the agent
under the contract are held by the agent for INDUS TOURS & TRAVEL LIMITED
until the date the agent pays the money to INDUS TOURS & TRAVEL LIMITED
3) CHANGES MADE TO THE SCHEDULED PROGRAMME
All arrangements for Soul of India tours are made well in advance. However,
changes may be necessary owing to the last minute change of flight schedule or
disruption of traffic etc. Such changes are of minor nature and we shall try all
possible to cover the services contracted for. However, if a material change is
applied to the programme which will involve a change of destination, means of
transportation or change of accommodation to a lower standard, the difference of
the cost between the cost of services paid for and services actually provided
will be reimbursed.
No compensation will be made where a change arises from circumstances beyond
our and our suppliers' control (force majeure) such as war, strife, civil
disobedience, terrorist activity, adverse weather conditions, fire, industrial
action etc.
4) CANCELLATION BY YOU
You may wish to cancel a booked holiday under unavoidable circumstances. This
cancellation must be received by us in writing from the person who has
contracted the holiday. The following cancellation charges will apply:
More than 56 days loss of deposit
29 to 56 days 35% of total cost of tour
16 to 29 days 65% "
02 to 14 days 75% "
Day of departure 100% "
5) CANCELLATION BY US
If INDUS TOURS & TRAVEL LIMITED cancels a holiday owing to circumstances
beyond its control, we will inform you or your travel agent without delay. An
equivalent alternative will be suggested and / or full refund of the monies paid
by you will be made.
6) PRICES
All prices mentioned for tour / travel arrangements are in pounds sterling.
Prices are subject to change if any levies are applied by the Government or
there is increase in hotel tariff or fuel costs, in which case a surcharge will
apply. We shall, however, absorb an increase of 2% of the costs before billing
you the supplement.
7) COMPLAINTS
If you have a complaint on any of the services provided by us within the
terms of the contract, please inform our nearest representative office first who
will do all possible to resolve the problem. Should the complaint be of a
serious nature please contact our Delhi Associate Office (address shown on our
service voucher). If the problem is still not resolved please contact us on 020
8901 7320. Any expenses incurred on telephone / facsimile or telex from overseas
will be refunded against production of the receipt of such charges.
8) ARBITRATION
Some problems may arise while you are on holiday. If you have a complaint
please write to us within 28 days of your return to the United Kingdom. We shall
investigate your complaint and forward a detailed reply. Investigation may
require obtaining reports from the destination and it might take time before we
get back to you with full details. If an amicable settlement is not reached
between you and INDUS TOURS & TRAVEL LIMITED, you may wish to take the case
for arbitration.
9) LIABILITY
9a: INDUS TOURS & TRAVEL LIMITED will do its best to make sure your tour
arrangements are satisfactory.
9b: INDUS TOURS & TRAVEL LIMITED accepts liability if any part of your
tour arrangement is not provided as described in the tour itinerary / tour
brochure in which case compensation will be paid. This does not apply where you
suffer personal injury or death.
9c: INDUS TOURS & TRAVEL LIMITED accepts liability for personal injury or
death that you suffer as a result of the omission or acts of INDUS TOURS &
TRAVEL LIMITED, its employees or agents under its control or omission by any
suppliers appointed by INDUS TOURS & TRAVEL LIMITED to provide service in
connection with your tour.
9d: Where the services in question consist of carriage by air or sea, INDUS
TOURS & TRAVEL LIMITED shall be entitled to limit its obligations and
liabilities in the manner as provided by the international conventions in
respect of air or sea carriers. Air travel is also subject to operational
decision which may result in the aircraft being diverted or delayed over which
INDUS TOURS & TRAVEL LIMITED has no control.
10) INSURANCE
An adequate travel insurance must be taken at the time of booking your
